This is my second letter
to you exactly two years todate; on the above product--the end
result of my 20 years of research work.
I am a research scientist
in the field of Enzymes and Alkaloids. My work has led to the
discovery of 35 virgin formats of enzymatic traits, and 12 master
alkaloids pre-emptors of invaluable accord to humankind...
In my letter of April
22, 1994, I contested the ruling you made in January 1990 concerning
Rogaine. The assertion was unequivocal in your statement. It
was that--and I quote: " Rogaine with 2% minoxidil is the only
product proven to stimulate hair growth." un quote.
The above ruling is
what led me to write you the letter referred to above; of which
I am enclosing a copy; and other scientific data collected over
the years legitimizing in total--the statement: AidooAid The
Bald No More System actually grows hair!...And that it grows
hair on sufferers of alopecia, including arieta, totalis and
androgenetica. (commonly known as male and female pattern baldness).
And unlike Rogaine, it has no side effects; and it grows hair
on all areas of the head -- not the vertex area alone, but also
frontal and what I call "annexal areas and patches."
I had included the
pictorial documentation to accent the uniqueness of my work.
Your action has led
to a state within which my life’s work was deduced to "semi-fraud"
in the face of those who heard our claim that: AidooAid
actually grows hair!
In spite of the fact
that I sent you all this information, your department was aware
of this breakthrough sometime back in June 1992, in which an
article was written about my work in the Sun Telegraph newspaper
of San Bernardino, California; and an interview with The Los
Angeles Times.
Before publication,
your office was contacted and a statement relayed to the above
newspaper by your West Coast Bureau Spokesperson Mike Shaffer,
conceded to our validity; and yet, there was no attempt on your
part to redress or rescind your statement.
Rogaine has been proven
not to grow hair as ascribed by your office... It is ineffective,
and by that dimension, has destroyed the public’s view and perception
toward legitimate claims such as ours. It cannot grow--and this
is for refutation purposes: one hundred th of hair AidooAid
is capable of... AidooAid
does not stimulate hair growth as asserted by Rogaine’s outlay...
It actually re-activates the dormant hair follicles to grow
hair again!...And it does not take 4 months or longer like Rogaine:
...The fact that it works with the follicles, the re-activation
becomes evident within two to three weeks upon use, sometimes
before! And being arranged with an organic coenzs, the new hair
does not fall "out" with reduction or cessation of use. And
therefore, unlike Rogaine, it is not a lifelong proposition...You
have all this--including all the pertinent scientific data on
your record!
My work has revealed
that there is an unnatural membrane which I call: gHanape-bio.
It grows to hinder--restricting the "free flow" of sebumatic
factors to the follicles. Once the gHanape-bio is debased, the
follicle(s) assume accord of viability--growing hair again into
its anagenic state.
I love
America, and I want America to benefit from my findings and
discoveries. And as a scientist, there have been times when
I have thought of selling/transferring my work to other nations
and pharmaceutical companies... In essence, offer them the leadership
in this arena.

a reply to this my second letter; to which copies are also sent

This is in
response to your letter of July 27, 1997, to Senator John McCain
regarding your product AidooAid. Senator McCain requested that
we respond directly to you.
According
to your letter, two previous letters you sent the Food and Drug
Administration (FDA or the Agency) were not answered. We want
you to know that the Agency has no record of having received
these letters, and we are sorry for the frustration you have
experienced in not receiving answers.
From the
information provided in your letter, we believe your product
has the potential to be considered a drug under the provisions
of sections 201(g) and 201(p) of the Federal Food, Drug, and
Cosmetic (FDC) Act (pertinent sections enclosed) which define
what is considered a drug under the law. Also enclosed is a
copy of section 310.527 of Title 21 of the Code of Federal Regulations
(CFR). This section provides information on products for hair
growth or hair loss prevention
FDA regulates
the manufacture, sale, and distribution of drugs in the United
States under the authority of the FDC Act, and reviews the data
included in New Drug Applications (NDAs) that are submitted
for approval. Enclosed is a copy of an FDA consumer special
report entitled "From Test Tube to Patient: New Drug Development
in the United States." This report will provide a general overview
of the drug development process. After reading this report,
you may wish to refer to the FDC Act and Title 21, CFR from
the Government Printing Office (GPO). These references contain
information such as regulatory definitions and the data needed
to support an approval of an NDA and marketing regulations (there
will be a charge for these manuals). Title 21, CFR is available

As per my e-mail of July
27, 1997, I hereby enclose the pertinent documents I advised

I take this moment to
thank you in advance for the speedy attention offered to my
e-mails. Again, thank you.
Sir, as the attached letter
(copy) sent to the then Commissioner of FDA Dr. David
Kessler will show, I am a research scientist in the field of
Enzyme and Alkaloid. My work has lead to the discovery
of 35 newly formatted Enzymes; and 12 Virgin Alkaloids of unparalleled
importance within the medium of science.
I have unraveled and utilized
the virtues coherent within one Enzymatic base--and supported
it with an adjunct (co-enzyme) in an empirical scientific arrangement
to achieve a breakthrough in the "re-activation" of
the dormant hair follicles to GROW HAIR again! ...Being that
this order of achievement is organic in it's accentuation, it
grows hair on all types of hair, and does not produce any side
effects.
...Within some of my other
prevailing base(s) of Enzymes and Alkaloids--all being proprietary
with legible style of conduction, there exist discoveries bearing
composers of other biological effusers capable of suppressing
and normalizing--in some cases: "idiopathic" human
abnormalities and diseases.
Over 5 years ago, a local
newspaper hearing of my work sent a team to cover it. (Sun Telegraph
of San Bernardino, California). Being that the FDA had
asserted there was nothing but Rogaine--a product serendipitously
discovered, and fundamentally a Drug for the controlling of
hypertension--and marked as a topical "hair growing"
product, I requested the Commissioner to rescind his words;
or investigate my claim. I have spent over 20 years in
this field of research--collecting data pictorially; and studying
the different forms of alopecia left to conjecture within the
scientific community...of which I have tonated usable terminology
for their identification.
I submitted my work to
AMA and over 1000 physicians in the field of dermatology; including
notable medical schools; and have been shunned due to the statement
made by the then commissioner in 1991 concerning Rogaine.
On two consecutive times,
I wrote Dr. Kessler providing him with all the necessary information
for revision; with no acknowledgement or reply resulting...
Sir, I believe that America
being the world leader within the field of science can only
hold on to it's leadership when people like myself are accorded
due recognition and equity--even in science; especially, when
I hold the secret to this phenomenon...including others yet
to be revealed.
My request is based on
the fundamental truth--which we all seek for: especially when
a statement is antithesis to the prevailing in science.
Sir, I have provided all the pre-requisite needed for revisiting
the Commissioner's statement; and have also written to Governor
Pete Wilson of California--as I reside in his state (copy attached).
I have since then received
an unceremonious visit by an individual who announced himself
as an FTC agent, who, after seeing the postings of documents
and pictures of "before and after" of some users in
my office, has failed to "officially" announce his
findings.
Sir, I wish and request
that your office and chair investigate what I have brought before
you. In a country where innovation and creativeness are
encouraged, I can only site a scenario of inadvertency on Dr.
Kessler's part; because, by all account--notwithstanding the
scientific and pictorial submitted, the statement made in his
capacity, clearly, legitimized Rogaine with monopolistic stripes:
an official rubber stamp--in essence, in an industry where they
have not been able to show any "scientific-pictorial"
proof:; especially, when the statement was with all accord of
conviction and honesty of an FDA Commissioner.. Unfortunately,
the said product (Rogaine) has since failed to live up to it's
relish: Based on what I have submitted, and by virtue of the
fact that my work has global connotation and meaning, that,
I be accorded an investigation into my citation...

I have received your letter
of October 21, 1997, in answer to one on my behalf from Senator
John McCain: the chairman of the U.S. Committee on Commerce,
Science and Transportation.
I was taken “aback”
by inference that you did not receive my letter sent to the
department—addressed to the former commissioner Dr. David Kessler.
To establish the viability
of my letter, I enclose herewith the “return receipt” of delivery
from the U.S. Postal Service.
In reading your
response,
I notice the “theme” of my letter—the contention and
the essence
of it—being the statement made by the then
commissioner that
Rogaine is the only product proven to grow hair was
not
addressed.
As I commented, the statement
was emphatical, very conclusive. It appeared to have represented
the totality of scientific motion, and as such resonated across
the GLOBE—measuring with his stand as the Commissioner of Unite
States Food & Drug Administration (FDA).
Ms. Thompson, the fact
of the matter is: my 12 year old son and his classmates cannot
understand why they clearly see in accord "hair" on
PEOPLE WHO DID NOT HAVE HAIR, (after examining pictures/data
of users of AidooAid and meeting some…) but are in essence
accosted to disregard the prevailing, and are to adopt
words of a trusted keeper of United States government—totally
inconsistent—and at odd with what they clearly see with their
reasoning: It demarcates their understanding; and are
left confused and frustrated!
--Pertaining to classification
of products, my research which covered more than 20 years, also
measured the categories under which “cosmetics and natural based”
products are augmented under the laws of the United States as
enumerated under the FDA guidelines. (By your suggestion,
I have re-visited them thoroughly—concentrating on the define
of “herbal,” as the base of my work fits more under this category.)
AidooAid is a “scientific
breakthrough” that uses a NON-DRUG base! And are unlike “drug”
based products such as Minoxidel (Rogaine by Upjohn), and Finasteride
(Merck’s Proscar), a drug awaiting your conferation.
Science, I believe, and
trust you will agree is still evolving. It does not have
answer(s) to all our ill(s) and will never. Your inversion
that it is only “drug” that has the ability to grow hair has
no bases; and by the data and support I have collected to date
deems that adage to be totally false. My work therefore,
has made such theory held before the emergence of AidooAid obsolete,
since the “proof and evidence” presented cannot be refuted.
At this state, I request
as a matter of scientific fact, that, a statement be made to
the effect that AidooAid has the ability to re-activate the
“dormant hair follicle” to grow hair again…and more so that
Rogaine or Finasteride; and without any of the side effects;
being that it utilizes “a breakthrough” catelization of enzymatic
order, to which the data and pictorial submitted to date suffice…
As I stated in my letter
to the Senator—in his esteem capacity, I believe this great
NATION called America epitomizes progress and truth; and I also
believe your department was requested to answer my citation.
This warrants clarification in view of the fact that AidooAid
grows hair…and achieves an unprecedented result, far capable
than any product out in the market (being those bearing activance
of Drug, OTC, Homeopathic or botanical/herbal preparation).
As you may have
seen the pictorial data presented on our internet site, AidooAid
grows hair on sufferers of male and female pattern baldness
(Androgenic Alopecia).
It stops hair loss; and unlike the others, it works well
on both frontal and vertex hair loss; and being that the base
is organic in composition, when a user discontinue its use after
he/she has grown their hair back, the hair does not fall out!
…This is achieved because of the fact that it is not a drug like
Minoxidel or Finasteride where cessation of use denotes resumption
of hair loss…and is meant therefore to be used indefinitely.
–They are drugs! —And as such unnaturally cajoles/stimulates
growth: usually “vellus” hair growth, while AidooAid facilitates
the “dormant hair follicle” to use its own chemistry to grow hair

Aidoo:
I am responding
to your November 17, 1997, letter to Diane Thompson at the Food
and Drug Administration regarding your product AidooAid. Your
letter has been referred to the Center for Drug Evaluation and
Research for a reply.
As stated
in Ms. Thompson's October 21, 1997, letter to you, we consider
your product to be a drug under the provisions of section 201(g)
and 201(p) of the Federal Food, Drug, and Cosmetic Act, therefore
the product may not be legally marketed unless the product has
an approved New Drug application (NDA). Further, regulation
coveing hair growht products in Part 310.527(b) (copy enclosed)
of Title 21 of the Code of Federal Regualations (21 CFR) state:
"(b)
Any OTC drug product that is labeled, represented, or promoted
for external use as a hair grower or for hiar loss prevention
is regareded as a new drug within the meaning of section
201(p) of the Federal Food, Drug, and Cosmetic Act (the
act), for which an approved new drug application under section
505 of the act and part 314 of this chapter is required
for marketing. In the absence of an approved new drug application,
such product is also misbranded under section 502 of the
act."
We are sending,
under separate cover, the document and forms for filing an NDA.
The NDA must contain adequate data, including clinical trials,
which establish that the drugs is safe and effective for the
intended use. This is the process of proving that your product
is effective, which has been the focus of your letter. The regualtions
covering the NDA process are found in 21 CFR 312 and 314. The
agency will be more that willing to review your new drug application
and clinical data supporting claims of safety and efficacy for
the AidooAid product. Once a completed new drug application
is received we can begin the review process of your product.
